The student dormitory, authorized by Zhoushan Campus, Zhejiang University (hereinafter referred to as “Party A”), agrees to assign Room_____, Building to Name , student number (hereinafter referred to as “Party B”). To guarantee both parties’ rights and obligations, and build a friendly and supportive learning and living environment, both Party A and Party B, in accordance with relevant college rules and regulations, sign the contract with equality and willingness.
1. Occupancy
1.1 Students enrolled on the Zhoushan Campus, Zhejiang University, can go to the dorm office to apply for foreign student accommodation with the proof from the International College. All the students should comply with all college rules and regulations, accept the assignment, pay housing fees in accordance with the dates specified, and check in within the dates specified.
1.2 Party A may, in its sole discretion, determine that Party B’s past behavior is served by acceptance or refusal of application, if Party B leaves the student dormitory but apply again during academic year. With the acceptance, Party B must re-sign a contract and accept any accommodations reassigned by Party A.
1.3 Party B is not allowed to share his/her accommodations with families or friends at any time.
2. Room changes
2.1 After the contract is signed, Party A may, in its sole discretion, make reassignments of space for the reasons including not only housing shortage, management, maintenance, alteration of accommodation.
2.2 Party B has the right to apply for changing rooms, if the living environment has an adverse impact on his/her learning and living and Party A can not help change the situation after his/her declaration.
2.3 Reasons for Building’s floor or building orientation will not be considered for room changes.
3. Termination
3.1 If Party B ceases to be a registered student as a result of graduation, withdrawal, dismissal, transfer or other permanent departure from campus, Party B must follow the move-out procedures with the time required. After the move-out procedures are completed, Party B may be released from this contract.
3.2 Party B who does need off-campus accommodation for personal reasons, must apply for it during the last one month of each academic year. With the approval by Ocean College and the student dormitory (and the guardian, if Party B is under 18 years of age), Party B can apply for the cancellation of on-campus housing contract.
3.3 Party B must move out of the student dormitory within three days after the move-out procedures are completed, and be responsible for maintaining his/her room in a clean and orderly condition as the original. Three days after Party B move out, any personal belongings left in the room shall be considered abandoned property, for which Party A will accept no responsibility.
4. Payments
4.1 For the term of this contract, Party B will pay to the campus the applicable rate for the housing space assigned to him/her. Each academic year has ten months and Party B agrees to be billed for each academic year. For the term of this contract, Party A may, in its sole discretion, revise the housing fees in accordance with relevant rules and regulations provided by Price Bureau of Zhejiang Province.
4.2 If Party B ceases to be a registered student as a result of graduation, withdrawal, dismissal, transfer or other permanent departure from campus, refund of the paid housing fees will be granted for the remaining months (not including the month in which the move-out procedures are completed). If Party B moves out for other reasons, housing fees for half an academic year will be charged even if the time is less than half an academic year and that for one academic year will be charged for the time is more than half an academic year but less than one academic year.
4.3 If Party B agrees to live in the student dormitory, housing fees for half an academic year will be charged even if the time is less than half an academic year and that for one academic year will be charged for the time is more than half an academic year but less than one academic year.
4.4 Party A provides Party B with a range of facilities and resources, the majority of which are free of charge.
4.5 Party B has 100-400 KWh for free in different months of each semester and the additional consumption will be charged.
5. The rights and obligations of Party A
5.1 The room assigned by Party A should meet Party B’s needs for living and learning. The furnishings Party A can supply are standard single bed, cabinet, desk, study chair, etc. All the facilities and furnishings should be in good condition.
5.2 Party A should publish all the housing disciplines, code of student conduct, rules and regulations. Party A should update and publish relevant information for management.
5.3 Party A is responsible for the maintenance and repair of public facilities, the operation and management of housing and the cleaning service for common areas.
5.4 Party A may enter Party B’s room during operational working hours for unscheduled inspection, including Party B’s cleaning responsibilities, safety, facilities and furnishings, etc. Party A reserves the right to supervise and inspect Party B’s room.
5.5 Violations of the rules and regulations may result in disciplinary sanctions. Party A reserves the right to terminate the contract, in the case of serious violation.
6. The rights and obligations of Party B
6.1 Party B has the right to supervise Party A’s operation and management, and offer advice. Party B could require Party A to make corrections if there are any serious impacts on Party B which caused by the fault of Party A.
6.2 Party B must pay the housing fees, extra electricity fee and other fees in accordance with the dates specified.
6.3 Party B must comply with all the laws, rules and regulations of Ocean College, International College and the nation. Activities, like any use of unauthorized electrical appliances, smoking, alcoholism, noise, overnight guest of opposite-sex, which may threaten other residents and safety, are prohibited.
6.4 Party B must comply with the Guest Policy and be responsible for the actions of his/her guests.
6.5 Party B must protect and properly use the facilities and furnishings which shall not be removed without Party A’s approval. Party B shall be liable for any damages to University Housing property. Cost including repairs and cleaning not under the responsibility of the University will be paid by Party B.
6.6 Party B shall not use the room assigned in any other manner than as a personal residence. Party B may not sell, sublease, or assign this Contract to anyone.
6.7 In consideration of the health and safety of all residents, Party B should report any detail of infectious disease or infectious agent, which may affect people, to Party A no matter it appears before or after occupancy, in or out of college, so that Party A can take emergency measures.
6.8 Party B should be responsible for maintaining a civilized environment, keep clean in both personal and public areas, respect other residents and staff, and protect the facilities and electrical appliances in the college.
7. Safety and Security of Property
7.1 Party B is responsible for the security of his/her own property and should not leave expensive items or much money in the room. Party A will accept no responsibility for theft, damage, or other loss of personal property, but help in investigation. Party B is strongly encouraged to purchase renter’s insurance through a private insurance carrier licensed by the nation.
7.2 Party B should protect the scene and call the police, if there is any loss of property.
8. Dispute Resolution
8.1 Any dispute of the contract should be negotiated and resolved at first by compromise settlement of both parties. If it can not be resolved, the final mediation will be made by the local court.
8.2 Except the disputable part of this contract, both parties should continue performing the remainder of this contract during the mediation process.
9. Others
9.1 Party A decides the duration of this contract, and that is, during the learning period since Party B registers after signs this contract until the date Party B checks out. The Contract will come into effect upon receipt by Party A of a signed contract from Party B (or Party B’s guardian if Party B is under 18 years of age).
9.2 Any irresistible external force (which is not under the control of both parties) occurs and obstructs the execution of this contract during the duration, this contract shall automatically expire. Both parties shall assume the loss respectively.
9.3 Any new stipulation issued by Party A, International Campus or the PRC which is inconsistent with this contract during the duration, the new stipulation prevails.
9.4 This contract contains two pages and it is in duplicate and both parties hold each which has the equal force of law.
